Terms of Service
These terms of service cover your use and access to the Lux Intelligent services, and the client software and website provided by Lux Intelligent.
Our Privacy Policy details what data we collect on your behalf, and our Acceptable Use policy describes your responsibilities when using our services.
By using our services you are agreeing to these terms, and to review our Privacy Policy and Acceptable Use policy.
Your Data, Reports and Permissions
When you use the Lux Intelligent cloud service you provide us with your Lux Intelligent Emergency Lighting Test system data and device status information. This data is yours, and these terms of service do not give us any rights to your data except for the limited rights that enable us to provide you with the service.
We need your permission to store and host your data, to back it up, and share it when you ask us to. Our services also provide you with facilities such as notifications when device status’ change, or devices fall into advisory conditions. By agreeing to these terms you give us permission to do these things.
Sharing your data
Our system allows you to share test data and panel information with others. So please consider what you share and with whom carefully before doing so.
Your Responsibilities
You are responsible for your conduct whilst using our systems, and you must comply with our Acceptable Use policy.
We may review your conduct for compliance with these terms and our Acceptable Use policy. However, we have no obligation to do so.
Please safeguard your account credentials, and ensure that others do not have access to it. You are also responsible for ensuring your account password complies with any corporate password strength and reset interval policies your employer may have in place.
Our Systems, Software and Intellectual Property
Our services are accessed via client software which we make available to you to download, and which we may update automatically.
As long as you comply with these terms we will extend to you a limited, nonexclusive, nontransferable, revocable license to use the software, solely to access the service. Please note that there is a license fee for the Lux Logger tool which forms part of the data upload part of the system.
You agree not to decompile the software or attempt to reverse engineer any part of the system or assist anyone in the attempt to do so.
Our services and software is protected by copyright. These terms do not grant you any right, title or interest in the services or software. We welcome feedback, but note that we may use comments or suggestions without any obligation to you.
Termination
You are welcome to stop using the services at any time. We also reserve the right to revoke your access to the system at any time, at our discretion and without notice.
Services “As Is”
We work hard to ensure that we provide a good service, however certain things are outside of our control, such as internet connectivity between your location and our cloud based service. The service is provided “As Is” and we disclaim any warranties or guarantees as to the availability of the service.
Modifications
We may revise these terms from time to time and will post the most current version on our website. If a revision meaningfully reduces your rights we will notify you. By continuing to use our service after the revisions come into effect, you agree to be bound by the revised terms.

Thank you for using the Lux Intelligent Cloud service. This document outlines how we handle and use your information when you use our mobile and web software, and our services.
The Lux Intelligent Cloud service allows users to monitor and share real time and historical status and test data from their emergency lighting systems.
Your data is stored securely on distributed servers operated by Microsoft (Azure) and remains your property. We will never share, sell or otherwise distribute your data to 3rd parties.
What Data We Collect, and Why?
We collect and use the following information to provide, improve and protect our services:
Account: We collect, and associate with your account, information such as a contact name, email address, billing amount and billing history. We do not store your physical address or any payment method information.
Service: When you use our service we transmit your emergency lighting test information to our cloud service, and store it in a secure data center for analysis and reporting within the mobile and web applications. If you add contact information to your account we will store this information to make it easier for you to share information and send reports to colleagues. We will not share it with 3rd parties.
Usage: We collect information about the devices you use to access the Lux Intelligent Cloud service. This includes information like the IP address, type of device used, amount of data transferred each way to your device. We need to do this to ensure we keep a track of which devices are currently used within your account, to access data. It also allows you to remove devices you do not wish to access data for whatever reason.
Cookies and other technologies: We use technologies such as cookies to provide you with access to our services, and to improve your experience using our services. For example, cookies help us to remember who you are between visits, and to secure your session when using our service via the web application. A cookie contains no personal data.
Data Sharing
We will not share any of your information with third parties or sell your information or usage statistics to advertisers or third parties.
Other Users: Our services may display your name or email address to other users where you have initiated sharing with them, or you have sent them a report. For example, if you shared a Site with a colleague, your colleague will receive an email stating "<your name> would like to share emergency lighting test information for <site name> with you".
Law & Order: We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to a) comply with the law; b) protect any person from death or serious bodily injury; c) protect Lux Intelligent’s or Advanced’s property rights, operations or reputation.
How We Use Your Data
In providing the service, we may use your data in the following ways.
Security: We constantly monitor our services testing for potential vulnerabilities and working to protect our services and access to your data. We also provide features to keep your information safe such as password encryption and protection from brute force attacks and notifications when new devices are used to access your account.
Retention: We will only retain your information for as long as is necessary to provide you the service. If you delete your account, we will also delete the information we hold about you. Please note that there may be some latency in deleting this information from our servers, eg where you account is deleted but still has a historic backup in our backup stack. Once your account has been deleted it will not be included in backups.
Also note that should your Lux Intelligent account lapse due to non payment, you will not be able to access your account or data. However, we will not delete your data from our systems until a further 6 months have passed. This is to ensure that should your payment be resolved, or your account is reactivated within 6 months you still have access to all historical testing data and your emergency lighting system remains compliant. However, you can request that we delete all data and information.
Where We Store Your Data
In order to provide you with our services, and in order to ensure a fast, responsive service we may store your information in multiple locations around the world including those outside your own country. We currently use Microsoft Azure, a premier cloud storage service that is owned an operated by Microsoft and is the backbone of many highly regarded cloud services around the world. In using the service, your information may also be stored locally on the devices you use to access the services. Also note that your Lux Intelligent panels and the Lux Intelligent Logger Tool connected to it/them will hold data from your panel/network. This is not part of the Lux Intelligent Cloud service as it is on your physical Lux Intelligent equipment.
Data Transmission
The data used by the Lux Intelligent Cloud service and shared by you/with you is generated by your Lux Intelligent panels/networks. The panel/network is attached to your local LAN TCP/IP network via a Moxa NPort Serial to IP device. This data is downloaded by the Lux Intelligent Logger Tool which sits on any compatible PC on your LAN. The Lux Intelligent Sync Tool then uploads your data to the Lux Intelligent Cloud via secure HTTP internet protocol, HTTPS. The data is completely secure and data can only pass up to the Cloud, in-bound communication is not possible keeping your LAN and Lux Intelligent network secure.

Changes
We will be developing the Lux Intelligent product line and Cloud service to add features, support more operating systems and devices. As a result we may also revise this Policy from time to time, and will post the most current version on our website and within the Web Application. If a revision meaningfully alters your rights, we will notify you.
In the unlikely event that Advanced is involved in a reorganisation, merger, acquisition or whole or partial sale of our corporate assets, your information may be transferred as part of that deal. We will notify you of any such transactions and outline your choices in that event. Your data will be protected under the terms of this agreement until you have made any choice.

Acceptable Use
You agree not to misuse the Lux Intelligent services. For example, you must not and must not make any attempt to do the following:
- probe, scan or test the vulnerability of any part of the system or network
- breach or circumvent any security or authentication methods
- access non-public areas of the site or services which you have not been given explicit permission to access
- interfere with or disrupt any other user or their account
- attempt to search the services by any other means other than that provided by us
- abuse the system in such a way to circumvent the data upload credits system
